What is this privacy policy for?

Personal information is data that can be used to identify or contact you.

Under the EU’s General Data Protection Regulation (GDPR) personal data is defined as: “any information relating to an identified or identifiable natural person ('data subject'); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”.

If we do collect personal data, we will nevertheless never collect sensitive personal data about you. The “legitimate interests” condition will not be met if the processing is unwarranted because of its prejudicial effect on your rights and freedoms, or legitimate interests. Use of data for advertising purposes

We happen to use data collected during your visit to create banners and ads when you visit other third websites. Those ads are created via pixels and are based on information we hold about you (such as search history) which explains why you will be able to see ads matching items that are similar to those you have checked out on our website.

All information use to create those ads are pseudonymized and we will never use data that clearly identify you.

To access what personal information is held identifaction will be required

Where you request access to your information, we are required to use all reasonable measures to verify your identity before doing so. These measures only exist to protect your information and to reduce risk of identity fraud, theft or unauthorized access to your information.

We therefore kindly ask you to send us original or certified copies of the following documentation: passport, identity card, birth certificate or driving licence. One of those above documents is required in order to request personal information.

How long do we keep your information?

We will hold your personal data for as long as you are you have an account and for as long as is necessary to comply with our legal/ regulatory obligations, resolve disputes, prevent fraud and abuse or enforce our terms and conditions.

When we no longer need to retain your personal data, it will be deleted or be anonymised so that you can no longer be identified from it.

We securely destroy all financial information once we have used it and no longer need it.

Our goal is to have all appropriate technical and organizational measures to ensure a level of security appropriate to the risk of processing and using personal data. We have safeguard processes in place in order to ensure the ongoing confidentiality, integrity, availability and resilience of our or third parties processing systems and services as well as the ability to restore the availability and access to personal data in a timely manner in the event of a physical or technical incident.

Your data is always store in secure environments and we provide training to our Staff on data protection best practices and require them to enter into a confidentiality agreement.

You can access and edit personal information after signing into your account. To sign in, you are required to know your login credentials - email address and password. There is no way to access personal information without knowing the login credentials, therefore no unauthorized party can access it. We therefore ask you to keep your password secret and to not share it with any person (even a friend!). Please, immediately inform us if you know or suspect to have lost your login or that someone else is accessing your account.

PV Commerce GmbH processes these data as the data controller within the meaning of Article 4 (7) GDPR. 4. Contract Data Processing

Personal data may be used when using the Klaviyo platform. This data may contain the following: (IP) address, surname, first name, gender, email address, login information, time zone setting, operating system and platform, information about visits including URL, search terms, information about what you have searched or viewed on our site, website response time, download errors, duration of visits to certain pages, information about website interaction (e.g., scrolling, clicks and mouse-overs) and methods used to leave the site, user activity, surfing on websites. Klaviyo processes these data as an order processor within the meaning of Article 4 para. 8 GDPR. The legal basis for the processing is our legitimate interest under Article 6 paragraph 1 letter f) GDPR.

5. Profiling

As part of a service, Klaviyo analyses personal data of PV Commerce GmbH website visitors (and customers) in order to create individual profiles. These profiles are used to predict future interests and to display targeted (online) advertising. The aim is to provide our website visitors with offers that are relevant and interesting to them. Profiling is based on the (surfing) behaviour of website visitors.

PV Commerce GmbH does not make any decisions solely based on automated processing that may have legal consequences for our website visitors (and customers) or significantly affect them. We perform profiling solely for the purpose of providing our website visitors with more attractive offers to purchase goods and/or services and to tailor the content of websites to the preferences of website visitors.

Within the framework of profiling, we do not process any special categories of personal data within the meaning of Art. 9 para. 1 GDPR.


 

Linkster

On this page we use the tracking technology of Linkster GmbH, Geschwister-Scholl-Straße 52, 20251 Hamburg, to measure and visualize insights into partnerships and advertising channels. This is a function for measuring the efficiency of the corresponding advertising measures. Furthermore, the information enables us to assign advertising successes for billing with corresponding advertising partners. If you click on an advertising integration, cookies are set in your browser, which are read out in the event of a transaction. At every touch point, your browser sends an HTTP request to the Linkster server with which certain information is transmitted. This information includes the URL of the website on which advertising material is placed (referrer URL), the browser identifier (user agent) of your end device (including information about the device type and the operating system), the IP address of the end device (This IP address is anonymized and hashed by us before storage), HTTP header (data packet automatically transmitted by your browser with various technical information), the time of the request and, if previously saved on the device, the cookie with its Content.

A cookie is a small data packet that is exchanged between your browser and the server. The information relevant to the web application can be stored and transmitted in this data package, e.g. the content of a virtual shopping cart. The tracking technology stores cookies on your end device to document actions. A 24-digit, anonymous ID is stored in the cookie. Linked to this ID, the data is encrypted in our database on the server. This contains information about the last touch points (i.e. when a particular advertising material was displayed or clicked on by a device). The stored touch points can, if necessary, be combined to form a sequence chain (user journey). With an action request, the order number and the shopping cart value of your order are usually also transmitted and saved by us. In addition, the following values can be transmitted and saved: your customer number, new customer characteristic.

The cookies saved by Linkster GmbH are deleted after 30 days at the latest. The information transmitted to us and the cookies only serve the purpose of correctly assigning the success of an advertising medium and the corresponding billing and is in line with our legitimate interests in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR.

If you do not want cookies to be stored in your browser, you can do this by setting your browser accordingly. You can deactivate the storage of cookies in your browser under Extras / Internet options, restrict them to certain websites or set your browser so that it notifies you as soon as a cookie is sent. Please note, however, that in this case you will have to reckon with a limited display of online offers and limited user guidance. You can also delete cookies at any time. The following overview shows which cookies are used by our tracking technology:

TRS: Unique, 24-digit identifier (ID) for tracking partnerships. This cookie is stored in the client browser and identifies database records that contain the touchpoint data.

TRSCJ: Fallback cookie with the rudimentary touchpoint data for tracking partnerships. This cookie contains all touchpoint data encrypted on the client browser.

trs_db_optout: When you click on the tracking opt-out link, a special cookie is written, which deactivates tracking in the current web browser of the end device. However, tracking is reactivated as soon as you delete the tracking opt-out cookie.


Whatsapp

You may use WhatsApp to contact us and start a conversation. We are the data controller within the meaning of Art. 4 No. 7 GDPR for subsequent data processing in connection with WhatsApp. For offering and using WhatsApp, we use the software solution of Charles GmbH, Gartensstr. 86-87, 10115 Berlin, under a data processing agreement. Charles stores all personal data in the EU. As an official WhatsApp partner, Charles uses the WhatsApp Business API with the consequence that within our responsibility no other third parties or WhatsApp gain access to your communication content.

Your use of WhatsApp is governed solely by the agreements you entered into with WhatsApp. According to the terms of use of WhatsApp, we have your phone number and username through your contact. We use this and other information you provide to recognize you and your preferences and to reply to your WhatsApp messages. The legal basis here is your consent to be contacted in accordance with Art. 6 (1) (a) GDPR. In addition, we will send you newsletters via WhatsApp, if you have given us your consent to do so. You can revoke consent already given at any time, with future effect. According to the GDPR, you also have the right to information, correction, portability, and deletion of your personal data, as well as the right to restrict or object to certain processing.

I am also aware that the website uses chatarmin.com GmbH, A-3400 Klosterneuburg, as the technical service provider and data processor for this service. My consent to the processing of personal data is always freely revocable; a corresponding notification to the website or Chatarmin is sufficient for this. Snapchat

We use the Snapchat service Snap Pixel and the product Snapchat Custom Audiences on our websites to optimize our advertising offer, provided you have given Snapchat your consent. For more information about these Snapchat services and Snap Inc.'s privacy policy, 2772 Donald Douglas Loop North, Santa Monica, CA 90405 ("Snapchat"), please visit the link https://www.snap.com/en-GB/ and their Privacy Policy. If you use a Snapchat user account, this can be recognized by the Snapchat pixel on our website, which transmits the collected usage data to Snapchat for analysis and marketing purposes. You can check and/or deactivate this data collection and the corresponding processing and use of the data by Snapchat directly in the Snapchat app. The Snapchat pixel is JavaScript code that transmits the following data to Snapchat:

  • HTTP header information (including IP address, web browser information, page location, document, web page URL and web browser user agent, and date and time of use)
  • Pixel specific data; this includes the pixel ID and your hashed email address (this data is used to link events to a specific Snapchat ad account and match them to a Snapchat user)
  • Additional information about visits to our websites, standard and custom data events: Orders placed (purchase transactions), complete registrations and trial subscriptions, additions to the shopping cart, calling up product information

The aforementioned data processing only affects users who have an account with Snapchat.
